     TERMS AND CONDITIONS

These Terms and Conditions (the “Terms and Conditions”) apply to every person who enters or uses GOLFBOX (the

“Facility”) in connection with a booking, event, lesson, league, tournament or other approved activity.

This includes use of the simulator bays, putting area, boardroom, common areas, access systems and related equipment or

amenities (collectively, the “Activities”).

1. Safety and Conduct Rules

● Only one person may be in the hitting zone or swinging a club at a time.

● Before every swing, confirm that no person, property or obstruction is within the swing area.

● Golf clubs may only be swung inside the designated simulator hitting area. No practice swings are permitted in

common areas.

● No horseplay, reckless swings, throwing of clubs or balls, climbing on platforms, or entry behind the impact screen.

● Do not touch, move, adjust, disconnect or tamper with projectors, cameras, launch monitors, computers, screens,

cables, access controls or other electronic equipment.

● Use only clean clubs, clean footwear and clean, unmarked golf balls. During wet or winter conditions, outdoor

footwear is not permitted in the hitting area.

● Follow all posted instructions, emergency notices, equipment instructions and directions from GOLFBOX.

● Report any accident, injury, unsafe condition or equipment damage promptly to GOLFBOX.

● GOLFBOX may pause or end a session, remove a participant, suspend access or cancel future bookings where

safety rules, Facility policies or laws are not followed.

● Refunds are not provided when a session is ended because of a participant’s conduct or breach of these rules.

● Failure to comply with any terms of this Agreement, any posted sign by GOLFBOX or any verbal/written

instructions provided to any person shall result in immediate termination of the booking without refund, removal

from the Facility, permanent suspensions from future bookings or financial responsibility where failure to comply

has resulted in any damage whatsoever.

2. Unattended Facility and Emergencies

I understand that GOLFBOX may operate without staff on site and that immediate in-person assistance may not be available.

In an emergency, I will call 911, provide the Facility address, follow emergency instructions and leave the premises when

directed by an alarm, emergency notice or authorized representative.

Emergency exits, fire equipment and access routes must not be blocked or tampered with.

3. Minors

A “Minor” is a participant under 19 years of age. A parent or legal guardian must authorize the Minor’s participation and

complete an Assumption of Risk, Release and Waiver (the “Waiver”) form as well as the parent/guardian acknowledgement

section below.

Participants under 14 years of age must also be accompanied and directly supervised on site by a parent, legal guardian or

responsible adult for the entire session.

The supervising adult remains responsible for ensuring that the Minor follows all Facility rules.

4. Booking Holder and Guest Responsibility

● A person who makes/has made the booking (the “Booking Holder”) is responsible for the conduct of all guests

associated with the booking and for communicating the Facility’s safety rules and policies. Booking Holder must

ensure all participants execute the waiver prior to attending.

● The Booking Holder must not share building, door, booking or session access codes with anyone who is not an

authorized guest for that booking.

● Access is permitted only during the booked time and only to areas included in the booking.

● Each simulator bay is limited to a maximum of four (4) people unless GOLFBOX gives prior written approval.

● No commercial instruction, coaching, lessons, events or other commercial activity may take place without prior

written approval from GOLFBOX.

● Pets are not permitted, except service animals as required by applicable law.

● The upstairs boardroom and any staff, utility, storage or restricted areas may not be entered unless included in the

booking or expressly approved by GOLFBOX.

● Participants must not permit unauthorized persons to follow them into the Facility.

● Participants must not interfere with or be a nuisance to any other Participants of GOLFBOX. Participants must

maintain reasonable noise levels and respect all other attendants within the facility.

5. Food, Beverages and Prohibited Substances

● No food or beverages are permitted on the hitting platform or beside simulator computers or electronic equipment.

● No alcohol is permitted whatsoever anywhere on the GOLFBOX premises.

● Smoking, vaping, cannabis and illegal drugs are prohibited anywhere on the premises.

● Any person who appears impaired, behaves unsafely or interferes with others may be required to leave immediately

without any refund.

6. Cleanliness, Damage and Charges

Participants must leave the simulator bay and common areas clean, orderly and ready for the next booking and must use the

Facilities responsibly.

Where applicable, the Booking Holder authorizes GOLFBOX to charge the payment method associated with the booking for

the following reasonable amounts, where permitted by the payment provider and applicable law:

● a $100 excessive-cleaning fee where additional cleaning or bay downtime is reasonably required because of spills,

loose garbage or an unusually dirty condition;

● the reasonable cost of inspection, technician attendance, repair or replacement for damage caused by misuse,

negligence, recklessness, tampering or intentional conduct; and

● any disclosed overstay, unauthorized-access or related charges shown during booking.

GOLFBOX may provide supporting details for a charge upon request. Serious or intentional damage may result in suspension

or permanent loss of Facility access and may be reported to law enforcement. GOLFBOX reserves the right to permanently

prohibit any participant for damage from future use of the Facility.

7. Personal Property

Participants are responsible for their own clubs, equipment and personal belongings.

GOLFBOX is not responsible for loss, theft or damage to personal property except where liability cannot legally be excluded.

Items left behind may be handled in accordance with GOLFBOX’s lost-property procedures.

8. Video Surveillance and Privacy Policy

The Facility uses video surveillance in simulator and common areas for safety, security, access control, incident review,

insurance and protection of people and property.

Cameras are not used in washrooms or other areas where a person would reasonably expect privacy. Unless separately and

clearly disclosed, audio is not recorded. You acknowledge that photographs or videos may be taken of you by GOLFBOX

during your time at the Facility.

Recordings may be accessed by authorized personnel and may be disclosed where reasonably required for incident

investigation, insurance, legal proceedings, law enforcement, or as otherwise permitted or required by law. Recordings will

be retained only as long as reasonably necessary for their purpose, subject to any legal, insurance or investigation hold.

Privacy questions may be directed to info@golfbox.ca. GOLFBOX may photograph or record promotional images or videos

within the Facility. By participating, I consent to the use of my image for promotional purposes without compensation unless

I notify GOLFBOX in writing before my booking. Tampering with surveillance equipment or security systems is strictly

prohibited and may result in financial liability and permanent suspension from the Facility.

All personal information provided through the TrackMan app or using our website and completing waiver form shall be

collected and maintained in accordance with our Privacy Policy.

9. Facility Access, Software and Third-Party Systems

TrackMan and other third-party names, software, courses, graphics and trademarks remain the property of their respective

owners. Participants receive only a limited right to use the systems during the booked or approved session. These GOLFBOX

Terms and Conditions are to be read in conjunction with the YOURGOLDBOOKING.COM LTD (YGB) Term and

Conditions. To book use of the Facility, you must create a user account on the TrackMan app (“Account”) by selecting a

username and password. You agree and understand that you are responsible for maintaining the confidentiality of your

username and password. To create an account, you may also be required to provide personal information. You agree to

provide true, accurate, current, and complete information. You agree not to disclose your password to any third-party. You

are solely responsible for all activities that occur under your Account. If you become aware of any unauthorized use of your

Account, you are responsible for notifying GOLFBOX immediately.

Participants must not copy, alter, reverse engineer, bypass, interfere with or misuse software, networks, accounts or

equipment. Course availability, software features and third-party services may change or occasionally be unavailable. Where

a material technical issue prevents reasonable use of the booked service, GOLFBOX’s remedy will be determined under its

booking and refund policy and applicable law.

10. Cancellation and Refund Terms

The cancellation, rescheduling, no-show and credit terms presented during the booking process form part of the Booking

Holder’s booking contract with GOLFBOX.

Bookings cancelled at least 12 hours before the scheduled booking time may be cancelled by the Booking Holder through

the booking system and, where applicable, the booking value will be returned as customer account credit rather than refunded

to the original payment method.

Bookings within 12 hours of the scheduled booking time cannot be cancelled through the booking system. The Booking

Holder must contact GOLFBOX directly regarding any cancellation or rescheduling request. Any credit, refund or other

accommodation within the 12-hour period is subject to GOLFBOX approval and applicable law.

Nothing in these terms or this Waiver limits any non-waivable rights available under applicable law.

GOLFBOX is not responsible for interruptions, cancellations or reduced playing time resulting from power outages, internet

failures, equipment malfunction, severe weather, emergencies or other circumstances beyond its reasonable control.

11. Electronic Acceptance and Records

I agree that electronic acceptance of these Terms and Conditions has the same effect as a handwritten signature. GOLFBOX

may retain an electronic record of the accepted wording, version number, date and time, participant identity, and related

booking or event information.

These Terms and Conditions once signed will apply to all of the Participants’ use of the Facility and/or engagement with

Activities offered by GOLFBOX regardless of how many times the Participant uses the Facility of engages in the Activities.

The Terms and Conditions contained herein shall bind on all future uses unless a new form is signed to reflect a change in

any of the Terms and Conditions.

12. General Provisions

These Terms and Conditions are governed by the laws of British Columbia and the applicable laws of Canada. If any

provision is found unenforceable, the remaining provisions continue in effect to the extent permitted by law. A failure by

GOLFBOX to enforce a provision on one occasion is not a waiver of future enforcement. Headings are for convenience only.

These Terms and Conditions, together with any applicable booking details and incorporated Facility policies, as well as the

Waiver, forms the agreement relating to participation in the Activities.

13. Participant Acknowledgement

I confirm that I have carefully read these Terms and Conditions, I understand its contents, understand that it affects

my legal rights, have had the opportunity to ask questions, and voluntarily agree to be bound by it. I agree to follow

all safety and Facility rules and accept responsibility for my conduct.

14. Parent or Guardian Acknowledgement for a Minor

I represent that I am the Minor’s parent or legal guardian and have authority to authorize the Minor’s participation.

I have read and understood these Terms and Conditions, I consent to the Minor’s participation, accept responsibility for

supervising the Minor as required, and agree to ensure that the Minor follows all Facility rules.

I understand that this acknowledgement binds me personally, and acknowledge that I am required to be personally

bound under the release, waiver and indemnity obligations within the Waiver.

GOLFBOX MEMBERSHIP TERMS & CONDITIONS
Winter 2026–2027

These terms apply to GOLFBOX Daytime, Nighttime and Anytime memberships.

1. Membership Options

DAYTIME — $149 per month + GST

• Six included private TrackMan iO bay hours per monthly billing cycle.

• Eligible times: Monday–Friday, 6 am–3 pm.

• 15% off additional eligible weekday daytime bay time.

• Book up to 10 days ahead.

• Maximum of one active future reservation.

NIGHTTIME — $99 per month + GST

• Eight included private TrackMan iO bay hours per monthly billing cycle.

• Eligible times: daily, 11 pm–6 am.

• 10% off additional eligible overnight bay time.

• Book up to 10 days ahead.

• Maximum of one active future reservation.

ANYTIME — $299 per month + GST

• One included private TrackMan iO bay hour per calendar day.

• Eligible times: 24 hours a day, seven days a week.

• 20% off additional eligible bay time.

• Book up to 10 days ahead.

• Maximum of two active future reservations.

All booking times refer to local time at GOLFBOX.

2. Winter Commitment and Monthly Billing

Memberships are commitments for the remaining winter membership term, paid in monthly instalments. Monthly billing does not make the membership a cancel-anytime subscription.

Payments are charged on the member’s monthly signup anniversary. The final scheduled payment is on that anniversary date in April 2027.

Membership access continues for one full monthly billing period after the final April payment, ending on the corresponding anniversary date in May 2027. For example, a final payment on April 15 provides access until May 15. No further winter membership payment is scheduled in May.

The member’s signup date determines the number of monthly payments remaining in the term. Memberships end after the final paid period and do not automatically continue into a summer membership.

3. Included Hours and Expiry

Daytime and Nighttime hours reset each monthly billing cycle. Unused hours expire at the end of that cycle and cannot be banked or carried forward.

Anytime includes a maximum of one bay hour per calendar day. Unused daily time expires at the end of that day and cannot be banked, stacked or carried forward.

Included time must be used within the membership’s eligible hours and active membership period.

4. Reservations and Additional Time

All reservations are subject to bay availability. A membership does not guarantee a particular bay, date or time.

Members must book through their own membership account and stay within their advance-booking window and active-reservation limit.

Additional bay time must be booked and paid for. Eligible member discounts apply according to the membership selected.

For example, an Anytime member may book a two-hour session using that day’s one included hour and purchasing the second hour at the eligible member rate, subject to availability.

5. Member Attendance and Guests

Memberships and their benefits are personal and non-transferable. The registered member must be present during any booking using membership hours or benefits.

Guests may share the member’s private bay, up to a maximum of four golfers in total, including the member. Included hours are bay hours, not hours per golfer.

6. Member Perks

All three memberships include:

• 10% off eligible standard GOLFBOX boardroom rentals.

• Access to GOLFBOX member competitions and TrackMan challenges.

• 48-hour early registration for eligible leagues, tournaments and member events.

Daytime members also receive first notice of selected clinics and coaching opportunities. Anytime Founding Members for 2026–2027 receive the first opportunity to renew before the next winter membership release.

Priority registration does not include event entry fees or guarantee a place.

7. Booking Cancellations and No-Shows

GOLFBOX’s published bay-booking cancellation policy applies to membership reservations. Late cancellations and no-shows result in forfeiture of the included membership time allocated to the booking.

Cancelling an individual bay reservation does not cancel the membership or its scheduled payments.

8. Membership Cancellation

Memberships are purchased for the agreed winter term. Early cancellation is subject to applicable law and any cancellation rights included in the member’s purchase agreement.

Nothing in these terms limits statutory cancellation or refund rights. Please send membership cancellation requests to info@golfbox.ca.

Members who purchased under earlier terms retain the cancellation provisions agreed to at purchase unless a change is agreed with them.

9. Events and League Use

Included membership hours are intended for regular personal play and practice. They cannot replace an event or party package.

Included hours cannot be applied to league bay time where that time is already included in the league registration fee.

10. Facility Policies

Members and guests must follow GOLFBOX’s Policies & Guidelines, safety requirements and applicable waiver requirements.
